Счет в HSBC ГК: Новые правила
На днях получил вот такое письмо:
Notice of Changes on the Business Integrated Account Terms and Conditions, effective 7 December 2015 ("effective date")
XXXXXXXXXXXX TRADING LIMITED
HSBC is introducing e-Cheque services as part of an industry wide launch of the new e-Cheque payment method in Hong Kong. e-Cheque is an electronic counterpart of paper cheque and will be issued and presented in digital form. e-Cheque provides an efficient, secured and environmental friendly alternative for you to make and receive payments.
To cope with these new services, a new Section IV (e-Cheques) is added to our Business Integrated Account Terms and Conditions to cover the following:
e-Cheques services provisions - applicability and definitions
Nature and scope of e-Cheques services
e-Cheques Issuance services
e-Cheques Deposit services
Handling of e-Cheques, associated risks and our liabilities
Separately, we have made the following changes to the Business Integrated Account Terms and Conditions:
a new clause 14 is added to section I (General Terms) to the effect that (a) you represent and confirm that neither (1) you, (2) any of your subsidiaries nor (3) any of your directors, officers, employees, agents or affiliates or that of any of your subsidiaries is an individual or entity ("Person") that is, or is owned or controlled by Persons that are the subject of any sanctions, or located, organised or resident in a country or territory that is, or whose government is, the subject of sanctions, and (b) you agree that you will not use the funds in any account or any financing provided by us, or lend, contribute or otherwise make available such funds to any subsidiary, joint venture partner or other Person (1) to fund any activities or business of or with any Person, or in any country or territory, that, at the time of such funding, is, or whose government is, the subject of sanctions or (2) in any other manner that would result in a violation of sanctions by any Person.
a new clause 16.12 is added to section I (General Terms) to clarify that no person other than you and us will have any right under the Contracts (Rights of Third Parties) Ordinance to enforce or enjoy the benefit of any of the provisions of the Business Integrated Account Terms and Conditions.
clause 7 of section XII (Business Internet Banking) (the existing clauses 8 to 20 will be re-numbered accordingly) in relation to confidentiality is removed in its entirety and confidentiality provisions are governed by clause 13 of section I (General Terms).
clause 11.6 of section XII (Business Internet Banking) (or clause 10.6 after renumbering) has been amended to reflect that we may modify the terms of the Business Integrated Account Terms and Conditions upon giving you prior notice by way of display in our premises or in the Consolidated Statements or by such other method as the we may decide.
clause 18.1 of section XII (Business Internet Banking) (or clause 17.1 after renumbering) has been amended to reflect that we may terminate the Business Integrated Account Terms and Conditions with prior notice (save under exceptional circumstances when termination may be made without notice) with or without cause.
clause 2.3 of section XVII (HSBC’s Direct Advice, eStatement and eAdvice Service) has been amended to reflect that we may from time to time include within the service or send with the eCorrespondence marketing materials relating to our products and services or those offered by other HSBC members and selected third parties if we have obtained your consent or no objection or otherwise permitted by law. You may request us to discontinue sending marketing materials to you by notifying us.
Please note that the amendments above shall be binding on you if you continue to use or retain your Business Integrated Account(s) on or after the effective date. If you decline to accept the amendments, you have the right to terminate your Business Integrated Account(s) before the effective date in accordance with the relevant clauses under the existing Business Integrated Account Terms and Conditions. If you have any queries, or should you wish to terminate any of your Business Integrated Account(s), please contact us at our customer service centres or call our customer service hotline on (852) 2748 8288.
При этом в конце октября был в HSBC и задавал вопрос офицеру о причинах закрытия счетов. На что был получен ответ: счета закрывают в случае отсутствия движений по счету, при отрицательном балансе и в случае, если нет возможности связаться с держателем счета. Ни о каких санкция не было и речи. У меня паспорт РФ.
